Okay so I have been thinking of a contract to right up for the current owners and I to sign when I go get the new girl.

I ________________ (current owner) sign over all ownership of Ripley to _______________ (new owner) on this day ___ of _________, 2009.

_______________ (current owner) has first refusal of buy back if ______________ (new owner) is not able to care and provide for Ripley.

I know there is some other things that I thought of that I can't for the life of me remember.

Might you want to specify price on the buyback? Your price or theirs? The value he was sold at today, or current market value then??? I don't know.

Oh yeah there will also be a picture of the horse on the contract.

I would add a physical description of the mare and any distinguishing characteristics/markings, and include photos (front/back/each side).

I forget the exact terminology, as I haven't personally sold a horse in some time. (I don't deal with people looking to buy horses, no one is ever good "enough", I forget most people need more than 30 seconds to mesh with a horse, so I never sell anything.)

But we have a thing where we, at our option, can "reposses" the horse if it's been keep poorly and declined in health without a history of vetrinary care. IOW, if they don't have documentation from a vet stating a legitimate cause (ie, horse got sick or injured etc...) we can take possesion of the horse. There's a 1 year limitation, and we only pay 75% of the original purchase price. (I've seen as low as 50%)

I need to see if that's legal here in Texas, I know it was in CA. I need a new atty...
