Java has been located!
When first contacted owner of farm owner was all excited about talking to java's previous owners... very cooperative as soon has he found out Java was NOT legally signed over to him he became defensive suddenly denying it was the same horse (several witness identified him as the man who came to get Java.)
We have a trailer and stall and money all lined up to get Java.. farm owner is now saying the horse is NOT there... adopted already... he is only 60 miles from the canadian boarder!
ANYONE with ANY information that might be helpful in us getting Java back PLEASE contact me RIGHT AWAY!!

it's confirmed he is/was at the farm as I located farms myspace and there are two photos of Java there.

I am in California so me going is not possible. However, his legal owner has a trailer all lined up to go and get him.
He had confirmed his where abouts and thankfully it is not as close to Canada as we first feared. Still a couple of hours away. So we are hoping that is in our favor.
The police are now involved.
Cheval- Back when I moved out to CA, I adopted him out to a friend. I didn't want to risk him traveling the distance to Cali. The adoptive owner fell on tough times and asked for help in caring for him. I couldn't from across the country but was helping her as best I could. She turned to a family friend and got the help she needed. To make a VERY long story short, I gave up my legal rights to the horse but she (adoptive owner) still holds rights to the horse via a signed contract between her and her "friend". I got word a few days ago he was not longer with the "friend" and at a rescue.
Through some detective work, after the "friend" wouldn't return calls. We found out today where he is. "Legal owner" contacted the "rescue", they were cooperative at first, then turned rude and now saying it isn't the same horse when photos on their website have confirmed it is and they confirmed it to when "legal owner" first called.
Superstb and I are doing all we can from her to help her claim him back. I wish I was there with her but I can't be.
All I can do is pray and hope he will be okay and provide any papers that I need to help her out.
I feel helpless as he is NOT an unwanted horse. He is very much wanted, there are several of my friends that will step up and help get him. We just want him safe.
thank you for letting me vent this out to you. I am trying to refrain from mentioning barn names or names of those involved for legal reasons. I am still not 100% from my asthma attack this week and I am trying despritely to keep calm. Hope for the best and prepare for the worst.
I feel like I have failed him in that he has to deal with being moved. But I know I wasn't the one that failed...
its the "friend" that failed him. And she has to live with "giving" him to a known dealer.

the police are involved. I have pulled all my old paperwork on him to help her prove it is her horse and we have many many witnesses too. It's in the police's hands now and I am going to be praying he is okay and it all works out.

Wow, crazy stuff. I take it the police have been to the rescue and the horse magically isn't there anymore? That's horrible. I hope they find it.

Misfit farm is a death sentence to any horse. No to mention they misrepresent themselves saying they are a rescue but they ship weekly to slaughter. There are NUMEROUS threads on Maine boards about him.

I have been advice to post ALL over the internet about stolen horse via a lawyer.
I have also been informed that since I only verbally released my right to Java, I would still be considered partial owner of him.
I am going to start posting everywhere.. contacting the local maine media, I need to see if I have the funds to post on netposse... even if Java is long gone we are going to FIGHT for him.

some promising news.
I can't really go into alot of detail's anymore but we are getting help from the MA police officer that java's owner filed the report. He has been a great help. So let's just all hope that Java has not been moved.
Thank you again everyone for your support I have watched the overwhelming support you have given to other forumers in need and to be on the recieving end is humbling. I am considering seeing about setting up a fund for getting him back but I am holding off on all that stuff until we get confirmation on whether or not he is still on the farm.

Just so you all know. All4 has talked with me. I will have a stall available Friday if we need to do an emergency immediate move for a period of time. I can be hooked on and ready to roll with about 20 mins. notice.
I have called 2 local dealers (yes one ships to Canada for meat) and told them about the horse and to watch for him and if they moved him it would be a legal issue.

*****UPDATE*****
This morning, the broker was reach...he was kinda cooperative in the he admitted he has Java, still owns him, he is out on adoption.
He refuses to work with us on returning Java to his rightful owner and told us we had to go through the courts to get the horse back.
AND we are, we collecting paperwork, letters, vet reports, contract, affidavits anything we can and we will fight to get Java back. I am going to look into starting a fund up to help assist java's rightful owner in the legal fees that she will insue over time.
Any help/advice you call can give me will be fantastic.

Well I am sure anything posted on this forum and possibly H.com related to java could be used as dated proof. Otherwise you need to move quick. You don't want him to cross over into Canada.. that will make things a lot more difficult.
Does the owner have a lawyer? I would think she will need an court order immeditley to prevent the horse from being moved. Perhaps the state police in Maine could issue one?

So, he is going back to the same girl that was at least 4 months behind on her board and left this horse 400 pounds underweight? Before all you people out there feel bad for her, you should know the facts. This horse was giving away because his old owner could not afford him and wasn't paying for food or anything but had enough money to maintain her ciggarette habit. When giving to the new owners, he was at least 400 pounds underweight and his teeth were in terrible condition, his mouth was killing him(vets words)! His feet hadn't been done in months. His new owners took him in and after many months, got him back to a good weight. He was placed with this rescue up in maine which came with HIGH recommendation. Not a slaughter at all!!!! HE WAS NOT STOLEN!!!! Paperwork proves it. Why would ANYONE give an animal back that they spent months recuperating back to the same girl that let him get into such bad shape in the first place!

I think the main issue for the OP here is that she used to own this horse prior to moving across the country and would like more than anything to be kept in the loop when it comes to this horse. I'm pretty sure that she just wants to know that he is safe and wanted and would like to have some contact with the current owner so that if the situation changes she can help place him in a new home.

Yeah, but seriously, I'd rather not this get blown up like the thread yesterday for All4's sake. She really cares about that horses' well being and that is the whole point. I think knowthefacts miscontrued the purpose of All4's threads. She's on the opposite side of the country from a beloved old horse and has no idea where he is or who has him. Naturally her mind is jumping to the worst conclusions and until proven otherwise she's gonna be a wreck.

This is going to be my final word on this subject. Java was rescued by me. 300+ pounds underweight, had not had teeth done in years, feet done in months. I have all paperwork from vet and farrier. His vet treated him at our place and when he was with the previous owner and after I had him for 5-6 months, didn't recognize him. Was shocked on how good he looked. Its all a bunch of crap. java is in an Excellant home that feeds him and loves him. If the previous owner had cared about him so much, he never would of gotten to the physical state he came to me in. The police have investigated and found I have done nothing criminally wrong. I just refused to give him back to the girl that let him starve in the first place. If that is a crime, then sue me. P.S. I have no hard feelings whatsoever for Bonnie, I didn't know when I adopted java that she had a contract with the other owner. If I had known that, I would never of gotten involved

Well, thanks for the update knowthefacts. I'm sure that All4Grace(Bonnie) is relieved to know your intentions and why she didn't receive an update when Java changed ownership.
I'm not sure if you've been in contact with her or not but maybe you could pass her info on to the new owners so they could keep her updated from time to time? I would understand not wanting to give their info out but if you passed hers on and then left it up to them whether they wanted to or not. I'm sure that's all she wants, is to keep updated on his life until the end. We're all horselovers here and I know everyone understands the heart ache she is going through.

The horse isn't apparently stolen, there is a statement that the previous owner neglected it (not all4grace), the horse is now in a good home.

The broker who has the horse is not a rescue.
The matter will now have to go through court.
Knowthefacts... if you had done your homework, and done a simple inquiry on the person you sent the horse to- you would know what type of business he runs. Funny that you claim to be a horse person, rescued Java, and you probably sent him down one of the quickest roads to Canada. You'll have to live with that...

Fact the place in Maine where this horse went is NOT a rescue and never will be. It has been PROVEN he ships to Canada and its been PROVEN he has lied. Its been PROVEN he can not be trusted and PROVEN he does not always have the horses best interest at heart!
Why was a registred 503 legit RESCUE not contacted instead of a *place* that post on CL, uncle henrys and horseville LOOKING for animals?? Poor judgment!

There are so many morally bankrupt people in the horse business you HAVE to be extremely diligent.
It's not that difficult in this day and age with the internet to find out just about anything on anyone. Personal info including criminal records can be had for $20 in mere minutes. Within an hour of knowing this dealer's name I had more info than I wish to know.
Knowthefacts- YOU have a contract with Amanda that you can use to help get Java back. Don't protect the dealer posing as a rescue. Get the horse back and we can find a legitimate rescue to send Java to OR put him down humanely so this does not happen again. God is not a bad owner.
I've just gotten word that there is a shipment of horses leaving within 48 hrs (if they haven't left already) to Canada. The shippers have a relationship in some fashion with Wilbur. I hope to god Java is not on that truck.

If the place that Java is at really is a broker, than he totally fooled me and a lot of other people. I didn't get his name off craigslist, actually he came recommended from someone who adopted a horse from him and had great results. I've been around horse people my whole life and he seemed like one of the legitate. Personally, I don't want him going back to Amanda for the soul reason that when I got him, he was severly skinny and I'm afraid he'll end up in the same state I got him in. At this point, I don't know what or who to beleive. I took him in and after a very long fall and winter, got him to a healthy state. I thought I was doing a good deed by giving him to someone who would take care of him.

Agreed. Everyone here wants the best for that horse. There is a lot of misinformation, and misunderstanding that created this situation. Now that things are being revealed maybe everyone here can just put everything else aside and work together to get Java in a safe place that everyone will be happy with. One forum member here even posted that she has room at her barn...and she is 15 minutes from where Java was last known to be. I think there is excellent potential here to get this resolved if there is cooperation on both sides.
